The ideology of “big is bad” is back, and this time it is at the European Commission! In a recent article published at the La Semaine Juridique – Entreprise et Affaires (JCP E), Thibault Schrepel denounces the vagueness that surrounds several concepts of European competition law and thus creates a very fertile ground for anti-domination theses that thrive in the United States. The result is a sanction of dominant positions rather than the sanction of the abuse of the latter.
