Avec sa proposition de directive du 22 novembre 2016, la Commission met \u00e0 la disposition des \u00c9tats membres un cadre de restructuration pr\u00e9ventif r\u00e9solument moderne et efficace fond\u00e9 sur les principes de l\u2019analyse \u00e9conomique du droit et inspir\u00e9 du fonctionnement du Chapter 11 am\u00e9ricain. Cette nouvelle approche, faisant figure d\u2019une petite r\u00e9volution silencieuse, b\u00e9n\u00e9ficiera en premier lieu \u00e0 la France qui doit s\u2019en servir comme base pour construire notre droit de l\u2019insolvabilit\u00e9 de demain.<\/p>\n
