Une justice gratuite est-elle compatible avec une justice de qualit\u00e9 ? Des indicateurs incitativement d\u00e9faillants et un budget qui ne permet pas de r\u00e9gler la “premi\u00e8re dette de la souverainet\u00e9” (Portalis) : un changement substantiel de paradigme pour la justice civile appara\u00eet n\u00e9cessaire, pour faire face aux d\u00e9fis contemporains. Nous proposons une \u00e9tude \u00e9conomique de l’impact de diff\u00e9rentes propositions de r\u00e9forme du financement de la justice sur les d\u00e9terminants des comportements des justiciables, dans l’optique de red\u00e9finir le r\u00f4le des tribunaux. A quelles conditions est-il possible d’influer sur les co\u00fbts mon\u00e9taires du contentieux afin de r\u00e9guler les comportements des justiciables, sans pour autant restreindre le droit \u00e0 l\u2019acc\u00e8s au juge pour tous ? Justice accessible \u00e0 tous ne signifie pas justice gratuite : nous montrons dans quelle mesure une meilleure efficacit\u00e9 \u00e9conomique des d\u00e9cisions et un syst\u00e8me d’incitations plus efficace permet d’am\u00e9liorer l’accessibilit\u00e9 effective des tribunaux et de corriger certaines in\u00e9galit\u00e9s.<\/p>\n
